General information clause for persons who initiate contact with the Law Firm via phone or e-mail

 

Dear Sir or Madam,

As a result of receiving your personal data from yourself, in line with the Article 13(1)and(2) of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter  the GDPR”) we hereby inform, that:

  1. The controller of your personal data is Krzyżagórska Łoboda i Partnerzy Adwokaci i Radcowie Prawni sp.p. with its registered office in Gdańsk, Piastowska 11 Street, entered into the register of entrepreneurs kept by the District Court Gdańsk-Północ in Gdańsk, VIIth Commercial Division of the National Court Register, under the KRS no. 0000647612, NIP no. 9571089251 (hereinafter the “Legal Office”).

and - unless otherwise specified in the separate, detailed information provided to you on this subject:

  1. The purposes of and the legal basis for the processing your personal data by the Legal Office, depending on the reasons and nature of your contact with the Legal Office, are as follows:
  • Taking action on your request before concluding of the agreement which is the basis for the cooperation between our Legal Office and you or the company you represent or the company which we contact through you, and, in case of conclusion of the agreement – its performance, including communication connected with it and pursuing claims related to the agreement (Article 6 paragraph 1 point b of GDPR),

and/or

  • Compliance with the legal obligations to which the controller is subject, including taxation, accounting, prevention of money laundering and terrorism funding, as well as obligations stemming from the legal profession (Article 6 paragraph 1 point c of GDPR),

and/or

  • Implementation of the defined objectives resulting from the legitimate interests pursued by:

(i) the controller - if you contact the Legal Office in connection with planned, existing or completed cooperation (in this case these interests may include: direct marketing, defense against claims, use of internal control systems),

and/or

(ii) third party - if you contact the Legal Office as a representative of such third party (in this case, this interest is expressed in enabling the third party to contact the Legal Office through you)

(Article 6 paragraph 1 point f of GDPR).

  1. Providing of the data required and allowing the Legal Office to process your data is neither a contractual nor statutory obligation (it is voluntary).
  2. The recipients of your personal data include or may include: employees and partners of the Legal Office, providers of IT support and the operation of information and communications tools and systems of the Legal Office, entity and persons providing access control to the offices, banks, providers of accounting, postal, courier and archiving services and other professional advisers, entities of self-government bodies of advocates and legal advisors, notaries, courts and other judicial and public administration authorities.
  3. Your personal data will be kept for the duration of the above (applicable) purposes of processing.
  4. You have the right to access your personal data and the right to rectify them, and - subject to restrictions regulated by law (including the GDPR) - to request their removal, request the processing restriction or rise objection against their processing and of their transfer.
  5. You have the right to lodge a complaint to The President of an Office Personal Data Protection if you consider that the processing of your personal data by the Legal Office violates the provisions of the law on the protection of personal data (in particular the GDPR).
