Bankruptcy and restructuring law

As part of consultancy in this area, the Legal Office of KLP provides the following assistance:
  • financial restructuring of companies, including, in particular, debt restructuring and the preparation of cost optimisation programs, including tax costs,
  • legal and economic analysis in the field of business management in crisis situations,
  • legal and economic analysis into the existence of conditions for the implementation of insolvency procedures,
  • advice on refinancing or changes in the form of financing companies, including but not limited to renegotiating the terms of agreements,
  • participation in negotiations with creditors,
  • development of applications for reporting bankruptcy on behalf of creditors or debtors,
  • development of applications for bankruptcy with the possibility of an arrangement, including legal and economic analysis of agreement proposals together with studies of their feasibility,
  • representation of creditors and debtors in bankruptcy proceedings, including in incidental proceedings during insolvency proceedings, in particular in proceedings relating to reporting and fixing claims, proceedings concerning approval of a distribution plan, proceedings on excluding entities and debts from the bankruptcy estate and proceedings for bankruptcy proceedings to be recognised as ineffective,
  • representation of the management of companies in proceedings relating to the untimely implementation of bankruptcy proceedings, including proceedings relating to the determination of civil and criminal liability of the board members of companies,
  • current legal service for the receivers of bankruptcy estates,
  • preparing applications and representing creditors in proceedings for a decision prohibiting business activity,
  • representation of shareholders and members of company authorities in proceedings for a ruling prohibiting business activity.

Our office, acting as legal advisor to the Compensation Administrator of Stocznia Gdynia S.A. participated in the compensation proceedings from March 2009, starting with preparation of the next stages of the sale of assets of Gdynia Shipyard worth over PLN 380 million.
